Pożaryskiego 28, Warsaw 04-703, KRS:0000857831, NIP [Tax Id No.]: 5250007684, REGON [Business Id No.]: 387388984, as the Seller and The tender organiser announces an open written public tender for the sale of the right of perpetual usufruct to a piece of land constituting an undeveloped plot of land marked with the number 435, geodetic district 0058, of an area of 2164 m², located in Pomorskie voivodeship, district of Gdańsk, in the municipality of Gdańsk City, ul. Narwicka 1, the use of which is “BP – urbanised undeveloped land or under development”, entered in the land and mortgage register No. GD1G/00051369/9, maintained by the District Court of Gdańsk-Północ in Gdańsk, III Land and Mortgage Department, hereinafter referred to as the “Subject of the tender”.
The starting price of the Subject of the tender is PLN 2,800,000.00 net.
VAT of 23% will be added to the net price determined as a result of the tender.
A condition for entering the tender is payment of a tender deposit in cash in the amount of PLN 280,000.00 before the deadline for submission of tenders (the date of crediting the bank account of the tender organiser shall be decisive), to account no: 38 1050 1025 1000 0024 2883 1099 at ING Bank Śląski, marked “Deposit – tender for the sale of the right of perpetual usufruct of part of a land property in Gdańsk”.
Bids should be submitted exclusively for the entire Subject of the tender, in accordance with the content requirements specified in the Rules of procedure for the sale by the Łukasiewicz Research Network – Institute of Electrical Engineering, with its registered office in Warsaw of the right of perpetual usufruct to a part of the land property constituting plot of land no. 435, precinct 0058, located in Gdańsk, ul. Narwicka 1, by written open tender until 16.04.2025 at 10:00 AM 10:00, in sealed opaque envelopes marked: “Bid in a written tender for the sale of the right of perpetual usufruct of a part of a land property in Gdańsk. Do not open before 16.04.2025 at 11:00 AM”. The name and address of the Bidder must be stated on the back of the envelope. Bids should be submitted at the seat of the Organiser in Warsaw at ul. Mieczysława Pożaryskiego 28, Warsaw (04-703) , on working days between 07:00 AM and 3:00 PM or sent to their above address, but no later than 16.04.2025 at 10:00 AM. 10:00. The date and time of receipt of the bid at the seat of the Organiser shall be decisive for the assessment of compliance with the aforementioned deadline.
The commission opening of the bids will take place at the registered office of the Organiser, address indicated above, in room 129, Building No. 3, on 16.04.2025 at 11:00 AM. 11:00.
The Seller is free to choose its bid if the Bidders have offered the same price.
The Seller reserves the right to change the terms and conditions of the tender or to cancel the tender or to close the tender without selecting an offer, without giving any reason and at any time. In the event that the tender is cancelled or closed without an award being made, the deposit paid is refundable.
The Subject of the tender may be inspected, by prior appointment at the following number +48 605 144 200 and e-mail address dominika.wemberger@iel.lukasiewicz.gov.pl, on working days, from the date of publication of the Announcement, until the day preceding the deadline for submission of tenders, between 9:00 AM and 2:00 PM, at its place of use, i.e. ul. Narwicka 1, Gdańsk, Pomeranian Voivodeship.

The tender deposit shall be forfeited to the Seller if none of the Bidders offers the purchase price of the Subject of the tender at least equal to the net starting price.
The deposit paid by the successful Bidder shall be credited towards the purchase price. The deposit made by Bidders whose bids are not accepted (not selected or rejected) will be refunded immediately after the bid selection.
The deposit shall be forfeited to the Bidder if the conclusion of the agreement at the indicated time and place has become impossible for reasons attributable to the Bidder.
The tender period is 180 days from the opening of tenders.
The conclusion of the conditional agreement in the form of a notarial deed will take place at a date and place determined by the Bidder, after obtaining the consent of the President of the Łukasiewicz Centre. In the event that the Organiser is refused the consent referred to above, the contract between the parties shall not be concluded and the tender deposit paid shall be immediately returned to the Bidder in the full amount.
The sale of the right of perpetual usufruct of a part of the real estate – on pain of invalidity of the agreement – is also conditional on the National Property Stock not exercising its pre-emptive right in favour of the State Treasury, pursuant to the provision of art. 30a of the Act of 20 July 2017 on the national real property resources (Journal of Laws 2024, item 1026).
The Subject of the tender will be released after the conclusion of an agreement transferring the right of perpetual usufruct of a part of the real estate.
